If you do not agree to these Terms in their entirety, you must not use this Site or purchase from us. Your continued use of the Site after any modification to these Terms constitutes your acceptance of the revised Terms.

To use this Site and purchase from SwapMyFilter, you must meet all of the following requirements:

• Be a resident of the United States or a US territory (our products ship within the US only)
• Have a valid US shipping address

Pricing: All prices displayed on the Site are in US Dollars (USD) and are exclusive of applicable taxes. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout — not any earlier or later displayed price.

Errors: In the event of a pricing error on our Site (e.g., a product listed at $0.01 due to a technical error), we reserve the right to cancel such orders and refund any amount charged, and to correct the displayed price. We will notify you promptly if this occurs.

Shipping terms, rates, estimated delivery times, and carrier information are governed by our Shipping Policy, which is incorporated into these Terms by reference. The following additional terms apply:

• Risk of Loss: Title and risk of loss for products pass to you upon delivery to the carrier. Once your order is handed to the carrier and a tracking number is assigned, the product is in your possession for risk-of-loss purposes.
• Delivery Address: You are responsible for providing an accurate and complete shipping address. We are not responsible for non-delivery caused by incorrect addresses provided by the customer. Re-shipment fees may apply for returned packages due to address errors.
• Delivery Estimates: All delivery timeframes are estimates and are not guarantees. Carrier delays, weather events, and other circumstances outside our control may affect delivery. We are not liable for consequential damages arising from late delivery.
• Undeliverable Packages: If a package is returned to us as undeliverable, we will contact you to arrange re-shipment or issue a refund minus original shipping costs (if applicable).

• No restocking fees on any return
• Guaranteed Fit Promise: If a filter matched through our compatibility system doesn’t fit, we replace it or refund it — no return required
• Prepaid return labels provided for all eligible returns
• Refunds processed within 3–5 business days of receiving your return

By purchasing from us, you acknowledge and agree that the Return & Refund Policy constitutes the complete and exclusive statement of our obligation to you with respect to returns, exchanges, and refunds.

Compatible Filters: All compatible filters sold by SwapMyFilter carry a manufacturer’s limited warranty against defects in materials and workmanship for the duration of the filter’s rated service life (typically 6 months or 200 gallons). This warranty does not cover damage caused by improper installation, misuse, or use with incompatible refrigerator models.

OEM Filters: Genuine OEM filters carry the manufacturer’s original warranty. Please refer to the manufacturer’s warranty documentation included with or available from the brand directly.

NSF Certification: Our NSF certification claims reflect third-party certification data at the time of listing. NSF certifications are maintained by the filter manufacturers and may be subject to change. We update our listings when we receive notification of changes but cannot guarantee real-time accuracy of certification status.

You may create an account on our Site to access order history, manage preferences, and speed up checkout. Account creation is optional — you may also checkout as a guest.

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must immediately notify us of any unauthorised use of your account at support@swapmyfilter.com
• You may not create more than one account or create an account for another person without their explicit consent
• We reserve the right to suspend or terminate accounts that violate these Terms

IN NO EVENT SHALL SWAPMYFILTER’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO SWAPMYFILTER IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow limitations on liability for incidental or consequential damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to defend, indemnify, and hold harmless SwapMyFilter, its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your violation of any third-party right, including intellectual property or privacy rights
• Any claim that your use of the Site caused damage to a third party

We reserve the right to assume exclusive control of any matter otherwise subject to indemnification by you. You agree to cooperate with our defence of such claims. You will not settle any such claim without our prior written consent.

Informal Resolution First: Before initiating any formal dispute process, you agree to contact us at legal@swapmyfilter.com and attempt to resolve the dispute informally. We commit to responding within 15 business days and genuinely attempting to reach a fair resolution. Most disputes are resolved at this stage.

Binding Arbitration: If an informal resolution cannot be reached within 30 days of your initial contact, you and SwapMyFilter agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English and the arbitral award shall be final and binding.

Class Action Waiver: YOU AND SWAPMYFILTER EACH AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR OR OUR RESPECTIVE INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

Small Claims Court Exception: Either party may bring qualifying claims in small claims court rather than arbitration, provided the claim remains in small claims court and is not removed to a court of general jurisdiction.

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which SwapMyFilter is registered, without regard to its conflict of law provisions.

For any disputes not subject to arbitration under Section 14, you and SwapMyFilter consent to the exclusive personal jurisdiction and venue of the state and federal courts located in our state of registration. You waive any objection to such jurisdiction or venue.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Last Updated” date at the top of this page
• Post a notice on our homepage for 30 days following the update
• For significant changes that materially affect your rights, send an email notification to registered customers
